Description

In every system of government, the powerful justice delivery mechanism is a standard and essential condition of peace, order, civilization and governance of the country. Just as pollution poisons the physical atmosphere, the poor justice system poisons the social atmosphere. Equal and fair justice is the hallmark of any civilized society. It is the primary responsibility of state to ensure same and even handed justice for all by regulating the dealings of people with one another, by checking disorder and high handedness of one class of people over others and by maintaining all these rights that are essential to the existence and upliftment of common man through organizing the powerful administration of justice. Administration of justice approach to adjudicate the rights and duties of the people on the idea of regulations laid down by the state. It makes efforts to provide the right to access to justice to all because access to justice from an impartial and independent organization in public law in addition to private law is an identified human right.

Equal access to justice to the humans through efficacious justice mechanism is important for the existence of a democratic system. In the words of Justice Brennan, “Democracy’s very life depends upon making the machinery of justice so powerful that each citizen shall consider in and advantage by its impartiality and fairness.” But, rendering of justice to the people, rich or poor, is not a minor trouble however a question of fundamental character. So, it turns into a sacred responsibility of the state to set up a judicial system in which people without any distinctions are enabled to vindicate their grievances and have justice at instantance without any delay on the part of the judiciary. Because, it is an essential requisite for the survival of the State.

Lok Adalats have competence to deal with a number of cases like:.

• Compoundable civil, revenue and criminal cases.

• Motor accident compensation claims cases.

• Partition Claims.

• Damages Cases.

• Matrimonial and family disputes.

• Mutation of lands case.

• Land Pattas cases.

• Bonded Labour cases.

• Land acquisition dispute

All the wrecks on either side of the circulation of time, all the wrecks of the exceptional cities, and all the nations which have exceeded away furnish a note of caution that no country founded upon injustice can stand. From the stand enshrouded Egypt, from the marble wilderness of Athens, and from every fallen, crumbling stone of once powerful Rome, comes a wail because it have been, the cry that no country founded on injustice can completely stand.

Conclusion

Keeping in view the motives of those historic facts, our Constitution makers emphasize to ensure justice to all even to the poorest of the poor through decentralized technique and inexpensive access. The Indian Constitution as a form of social document is a significant symbol of the hopes and aspirations of the people life. It is intended by the makers of the Constitution that the largees of law must belong to all, not, as now, to people who use the Constitution for unconstitutional ends. They have been quite hopeful that the poor and the needy should not be at the victims end however at the consumers end. Their purpose turned into to wipe every tear from every eye and it is anticipated that the regulation have to go to eye and not compel the weaper to reach the urban-based lawyer and judge.
